The short answer
Texas has no legal sports betting, and its Penal Code makes it an offence to bet on a game, a contest or an election. Even so, no Texas authority has acted against Kalshi or Polymarket US, and both offer contracts to Texans on the argument that a contract on a CFTC-registered exchange is a swap governed by federal law, not a bet.
That is a gap, not a permission. No Texas court has ruled on whether these contracts are bets under Texas law, and the Legislature has spent 2026 studying the question ahead of its next regular session in January 2027.
The international site, polymarket.com, is a different product. It does not accept new trades from anywhere in the United States, Texas included, under Polymarket's own documentation.

What Texas law says
Section 47.02 of the Penal Code makes it an offence to bet on "the partial or final result of a game or contest or on the performance of a participant", or on "the result of any political nomination, appointment, or election". It is a Class C misdemeanour. There are defences for gambling in a private place where nobody but the players profits and the odds are the same for everyone, and for state-authorised activity such as the lottery, bingo and racing.
Section 47.01 defines a bet as "an agreement to win or lose something of value solely or partially by chance". Its exceptions cover insurance, prizes in genuine contests of skill and small carnival prizes; none mentions contracts listed on an exchange. Whether federal law displaces this definition for CFTC-registered contracts is the question being fought in other states' courts, and no Texas court has addressed it.
The Texas Lottery Commission, sometimes named as the regulator, no longer exists: a 2025 law dissolved it on 1 September 2025 and moved its work to the Department of Licensing and Regulation. Vultax found no statement from that department on prediction markets.
What the Legislature is doing
In March 2026 Lieutenant Governor Dan Patrick gave the Senate State Affairs Committee an interim charge headed "Closing Gambling Loopholes": to "study the sudden inundation of prediction market gambling and the exploitation of federal law to circumvent Texas gambling prohibitions". The committee's page lists interim hearings on 23 June, 14 September and 15 September 2026. Press reports describe testimony from Kalshi, the American Gaming Association and the Kickapoo Traditional Tribe of Texas.
A study charge is neither a ban nor an authorisation. The only report on the committee page is its 2024 interim report, and the next regular session opens in January 2027, when any bill would have to start.
Where Texas stands in the national fight
Texas has kept out of the multistate briefs. It is not among the 37 states California's Attorney General listed on 29 October 2026 as backing Utah against Kalshi, and CNBC reported that it was one of five states that did not sign the attorneys general's July letter telling the CFTC it lacks authority over sports contracts.
Texas is in the Fifth Circuit, which has not ruled on the question. The Third Circuit sided with Kalshi against New Jersey in April 2026, and the Ninth and Sixth Circuits sided with Nevada, Ohio and Tennessee in August and September. Three petitions ask the Supreme Court to settle whether federal law displaces state gambling law for these contracts. Responses are due on 13 and 16 November 2026 in two of them; in the third, New Jersey's (No. 26-299), the response is due on 9 November, and Kalshi asked on 29 October, unopposed, to move it to 7 December.
On 19 October the CFTC put into force an interim rule keeping casino-style gambling products offered under a state or tribal gambling authorisation outside the definition of a swap, and separately proposed adding specified event contracts to that definition; comments on the proposal close on 18 November. Neither measure changes Texas law. The US guide follows the national picture.
What this means if you are in Texas
- Kalshi and Polymarket US - No Texas order stops them, and both take Texas customers under their federal registration. Texas law has not been tested against them.
- Election contracts - Section 47.02 names betting on elections specifically. Whether that reaches a CFTC-registered election contract is undecided.
- polymarket.com - It does not take new trades from the United States, and Polymarket's help page says using a VPN to get around that breaks its terms.
- What to watch - The Senate committee's report, bills filed for the January 2027 session, and the Supreme Court's decision on whether to hear the pending petitions.
Method and limits
The Penal Code was read from the Legislature's statutes site, and the Senate committee page, the Attorney General's release on the Utah brief, the Supreme Court dockets, the CFTC's rules and the venue documents on 30 October 2026. Testimony at the September hearings is as press reports describe it. Texas district-court dockets were not searched, and Vultax did not test access from Texas.

Questions this page answers
- Is Kalshi legal in Texas?
- Kalshi takes Texas customers under its CFTC registration, and no Texas authority has acted against it. Texas law makes betting on games and elections an offence, though, and no Texas court has ruled on whether Kalshi's contracts are bets. Finding no action is not a ruling that they are lawful.
- Is Polymarket legal in Texas?
- polymarket.com does not take new trades from anywhere in the United States. Polymarket US, the CFTC-registered app, is not named in any Texas action Vultax found and its terms name no excluded state; Texas law on it is untested.
- Is sports betting legal in Texas?
- No. Penal Code section 47.02 makes betting on a game or contest a Class C misdemeanour, with defences for private social games and state-authorised activity.
- Is Texas going to ban prediction markets?
- Nothing has been proposed yet. A Senate committee is studying prediction markets under an interim charge called "Closing Gambling Loopholes" and held hearings in June and September 2026; any bill would come in the session that opens in January 2027.
