Is Kalshi Legal in Texas? Kalshi, Polymarket and Texas Gambling Law

Texas makes betting on games and elections a crime, but no Texas authority has acted against Kalshi or Polymarket US. What the Penal Code says, what the Senate is studying, and how polymarket.com differs. Texas has no legal sports betting, and its Penal Code makes it an offence to bet on a game, a contest or an election. Even so, no Texas authority has acted against Kalshi or Polymarket US, and both offer contracts to Texans on the argument that a contract on a CFTC-registered exchange is a swap governed by federal law, not a bet. That is a gap, not a permission. No Texas court has ruled on whether these contracts are bets under Texas law, and the Legislature has spent 2026 studying the question ahead of its next regular session in January 2027.
